About Prop-Assist
This website is operated by Mr A Horton, trading as Prop-Assist ("Prop-Assist", "we", "us", "our"), based at Lake Weyba Drive, Noosaville, Queensland 4565, Australia.
Prop-Assist is a private property buyer. I purchase residential properties on the Sunshine Coast, including distressed homes, deceased estates, and properties where the owner is under mortgage stress. I am not a real estate agent, lawyer, financial counsellor, mortgage broker or licensed credit provider.
Nature of services
Through this website and during direct engagement, Prop-Assist may:
- Discuss your property and financial situation on a confidential, no-obligation basis.
- Offer to buy your property, in whole or in part, on terms agreed in writing.
- Refer you to free, independent services such as the National Debt Helpline, Legal Aid Queensland, or a financial counsellor.
- Provide general information about the Queensland property market, the foreclosure process, and options that may be available to homeowners in financial distress.
Any information provided through this website, in person, by phone or by email is general in nature. It is not legal, financial, taxation, credit or real estate advice. You should obtain independent professional advice before acting on anything Prop-Assist tells you, or before signing any agreement.
Eligibility and decision-making
By engaging with Prop-Assist you confirm that:
- You are at least 18 years old.
- You are the legal owner of the property in question, or you are authorised to act on behalf of the owner (for example, as an executor of a deceased estate or under a power of attorney).
- You are making your own decisions freely and have not been pressured by Prop-Assist or anyone else to sell, sign or agree to anything.
- You have had, or have had the opportunity to obtain, independent legal advice before signing any contract of sale.
No fee for initial consultation
Initial conversations with Prop-Assist are free and confidential. No fee is payable unless and until you sign a written contract of sale. If you do sign a contract, the terms of that contract will set out the agreed purchase price and any other commercial terms. The cost of your own independent legal advice, conveyancing and any other professional services you engage is your responsibility.
Property purchases and contracts
Any offer Prop-Assist makes to purchase your property is subject to:
- Inspection of the property and verification of title.
- A written contract of sale executed by both parties.
- Any conditions specified in the contract, including but not limited to finance, building and pest inspection, and clearance of any caveats or mortgages.
Verbal indications of price are not binding offers. A binding offer exists only once a written contract has been signed by both parties in accordance with the Property Law Act 2023 (Qld) and the standard REIQ contract terms (or such other written contract as is agreed).
Where a property is the subject of mortgagee enforcement action, the cooperation of your lender may be required to complete the sale. Prop-Assist cannot guarantee that a lender will agree to any particular settlement amount or timeline.
Your obligations
When dealing with Prop-Assist, you agree to:
- Provide accurate, complete and honest information about the property, your ownership of it, and your financial circumstances to the extent relevant.
- Disclose any defects, encumbrances, caveats, current mortgagee or repossession proceedings, tenancies or other matters affecting the property of which you are aware.
- Not provide false or misleading information to Prop-Assist, your lender, your solicitor, or any government body in connection with any transaction.
Prop-Assist relies on the accuracy of the information you provide. If you provide false or misleading information, any offer may be withdrawn or any contract terminated in accordance with its terms.
Privacy
Personal information is collected, held and used in accordance with the Privacy Act 1988 (Cth) and the Prop-Assist Privacy Policy, available at propassist.com.au/privacy-policy. By using this website or engaging with Prop-Assist, you consent to the handling of your personal information as set out in the Privacy Policy.
