Prop-Assist takes your privacy seriously. This Privacy Policy explains how personal information is collected, used, stored, disclosed, and protected when you visit propassist.com.au or engage with Prop-Assist by phone, email, in person, or through any other channel.
Who this policy applies to
This policy applies to Mr Horton, trading as Prop-Assist ("Prop-Assist", "we", "us", "our"), based at Lake Weyba Drive, Noosaville, Queensland 4565.
Prop-Assist is a sole trader operating in Queensland. The Privacy Act 1988 (Cth) applies to organisations with an annual turnover of more than $3 million, and to certain other organisations regardless of size. As a small business below that threshold, Prop-Assist is not legally bound by the Privacy Act. However, because Prop-Assist works with people during financially sensitive moments in their lives, Prop-Assist voluntarily applies the Australian Privacy Principles (APPs) as a matter of best practice.
This policy describes those practices.
What is personal information
Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable. This includes your name, address, phone number, email address, date of birth, financial details, property details, and any other information that can identify you.
Sensitive information is a special category that includes things like health information, racial or ethnic origin, religious beliefs, political views, and criminal records. Prop-Assist does not actively seek sensitive information from you and asks that you not provide it unless you have a clear reason and consent for Prop-Assist to use it.
What personal information is collected
Prop-Assist may collect the following kinds of personal information:
- Contact details, including your name, address, phone number and email address.
- Property details, including the address of the property, ownership status, title information, condition of the property, and any photographs or videos you provide.
- Financial information relevant to a potential transaction, such as the existence of a mortgage, whether you are in arrears, the name of your lender, any default or repossession notices, and the approximate amount owing.
- Information about other decision-makers connected with the property (for example, co-owners or executors), where you have provided it and have the authority to do so.
- Information you give in any web form, email, phone call or meeting with Prop-Assist.
- Technical information collected automatically when you visit the website, such as IP address, browser type, device type, pages visited, time spent on the site, and referring URLs (see section 8 below).
How personal information is collected
Most personal information is collected directly from you, including when you:
- Submit the contact form on the website.
- Email or telephone Prop-Assist.
- Meet with Prop-Assist in person.
- Provide documents about your property or financial situation.
In some cases, personal information may be received from third parties, including your authorised representatives (such as a solicitor, accountant, or family member acting on your behalf), public registers (such as Queensland land title records), or service providers Prop-Assist uses (such as a conveyancer or surveyor). Where information is collected from a third party, you will be advised of this where reasonable and practical.
Why personal information is collected and how it is used
Personal information is collected and used for the following purposes:
- To respond to enquiries you submit through the website or by other means.
- To assess whether your property is one Prop-Assist may wish to purchase.
- To prepare and present an offer to you and, if accepted, to progress the property purchase.
- To communicate with you about your situation, the property, and any related transaction.
- To meet legal, regulatory, accounting, taxation, or contractual obligations connected with a property purchase.
- To improve the website and the way Prop-Assist communicates with people in similar situations.
Personal information will not be used for direct marketing without your consent. If you would like to opt out of any communication, you can do so at any time by contacting Prop-Assist using the details in section 13.
Who personal information is disclosed to
Prop-Assist treats personal information as confidential. Disclosure may occur in limited circumstances, including:
- To Prop-Assist's solicitor, conveyancer, accountant or other professional advisors, where reasonably required in connection with a potential or actual property purchase.
- To your own representatives, where you have authorised the disclosure.
- To government bodies (for example, Queensland Titles Registry or the Australian Taxation Office) where required in connection with a property transaction.
- To a court, tribunal or regulator where required by law.
- To third party service providers Prop-Assist uses to operate its business, such as the website host, email provider, and analytics provider, on a strictly need-to-know basis (see section 8 below).
Prop-Assist does not sell, rent, or trade personal information to third parties.
Overseas disclosure
Personal information is held in Australia wherever practicable. However, some technology service providers Prop-Assist uses (for example, Google for analytics and Site Kit, and the website hosting provider) may store data on servers located outside Australia, including in the United States and other countries. Where this is the case, those providers are bound by their own privacy frameworks. Prop-Assist takes reasonable steps to select providers that handle data securely and consistent with Australian standards.
Cookies, analytics and the website
The Prop-Assist website uses cookies and similar technologies. A cookie is a small text file stored by your browser. Cookies allow the website to recognise repeat visitors, understand how the website is being used, and improve the user experience.
The following analytics and tracking tools are currently used on the website:
- Google Analytics 4 and Google Tag Manager : to measure overall website traffic, popular pages, and how visitors arrive at the site. Data sent to Google is aggregated and not used to identify individual visitors by Prop-Assist.
- Google Site Kit : a WordPress plugin that connects the site to Google services including Analytics and Search Console.
- Google reCAPTCHA : to protect the contact form from spam and automated abuse.
You can disable cookies in your browser settings. Doing so may affect some functionality on the website but will not prevent you from contacting Prop-Assist by phone or email.

Data security
Prop-Assist takes reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure. These steps include:
- Storing electronic information on password-protected devices and reputable cloud services.
- Limiting access to personal information to those who reasonably need it to do their job (including Prop-Assist's professional advisors).
- Securely deleting or destroying personal information when it is no longer required for the purpose for which it was collected, subject to legal record-keeping obligations.
No system is perfectly secure. While reasonable safeguards are in place, transmission of information over the internet always carries some risk.
How long personal information is kept
Personal information is kept only for as long as needed to fulfil the purposes for which it was collected, or as required by Australian law. For example, financial and transaction records relating to a completed property purchase are generally kept for seven years to meet taxation requirements. Information you submit through a contact form, where no transaction proceeds, will generally be deleted within 24 months unless you ask for it to be retained or deleted earlier.
Your rights
You have the right to:
- Ask what personal information Prop-Assist holds about you.
- Request access to that information.
- Ask for personal information to be corrected if it is inaccurate, out of date, incomplete, irrelevant or misleading.
- Withdraw your consent to the handling of your personal information, where consent is the basis on which it is held.
- Ask for your personal information to be deleted, subject to any legal obligation that requires Prop-Assist to retain it.
To exercise any of these rights, please contact Prop-Assist using the details in section 13. Prop-Assist will respond to your request within a reasonable time, generally 30 days.
How to make a privacy complaint
If you believe Prop-Assist has mishandled your personal information, please get in touch first using the contact details in section 13. Most concerns can be resolved quickly and directly. Prop-Assist will acknowledge your complaint within 7 days and aim to resolve it within 30 days.

Please note: as a small business below the $3 million turnover threshold, Prop-Assist is not normally bound by the Privacy Act 1988. The OAIC may not have jurisdiction to investigate a complaint, but the OAIC can still provide information about your rights and options.
